VA Claim Representation Fees Explained

The first fee question is whether charging you is permitted at that stage of the case. The next questions are what the agreement covers, how payment works, and whether the amount is reasonable.

Identify The Stage Of The Claim

For an initial disability claim, an attorney or claims agent cannot charge you for preparing and filing the claim before VA provides notice of its initial decision. OGC includes gathering documents and completing claim forms within that restriction. Waiting to collect payment does not turn prohibited initial-claim work into permitted paid representation.

After an initial decision, an accredited attorney or agent may charge for eligible review work when the applicable requirements are met. Older legacy cases have additional timing rules. Court representation and the statute's VA home-loan exception have distinct rules; this article addresses ordinary disability-claim representation before VA.

Read Both Documents

The appointment and the fee agreement do different jobs. Form 21-22a appoints an individual representative. A fee agreement sets payment terms and must be written and signed by both parties. The representative must meet the applicable filing requirements for that agreement.

Ask which issues and review stages are included, how the fee is calculated, whether expenses are separate, and who collects payment. Keep complete copies rather than only a signature page. Accredited VSO claim assistance is free, including eligible help after a denial.

Distinguish Direct Payment From Other Fees

Under a qualifying direct-payment agreement, VA pays the representative from past-due benefits. The total fee, excluding expenses, cannot exceed 20% of those past-due benefits, and payment must be contingent on a favorable outcome. Other regulatory conditions also apply.

That direct-payment ceiling is not a universal ceiling on every permitted fee arrangement. Non-direct-payment agreements can use reasonable fixed, hourly, or percentage fees. Conversely, a fee of 20% is not automatically reasonable in every case. Ask for an explanation tied to the work and the agreement.

Plan For A Change Of Representative

Discharging a representative does not automatically erase the fee agreement or make earlier work unpaid. For a contingent fee where representation ends before an award, the regulation ties a reasonable fee to the former representative's contribution and responsibility for the benefits awarded.

Before changing representation, preserve the agreement, submissions, work history, and termination correspondence. Ask the departing and incoming representatives how any possible fee claims will be handled. Do not assume a new appointment settles that separate question.

Read A Fee Notice Promptly

Current OGC guidance gives 60 days from the fee allocation notice to request review of a default allocation. The request must explain the proposed reasonable allocation and include the supporting argument and evidence.

A disagreement about direct-payment eligibility follows a Board appeal route instead. Identify what the notice actually decided and follow its instructions promptly. A routine complaint or telephone call is not a substitute for the required fee-review filing.

No. You may file yourself or seek free accredited assistance. Accredited VSO services on VA benefit claims are free.

Not automatically. Appointment, fee eligibility, and reasonable allocation are separate questions. Preserve the agreement and review any fee notice promptly.
