Appealing To The Court Of Appeals For Veterans Claims
A Court appeal follows a final Board decision and ordinarily starts with a Notice of Appeal within 120 days. Filing with the Court is separate from filing with VA.
Confirm That The Decision Is From The Board
The Court's instructions require a final Board decision before an appeal to the Court. A regional-office rating decision or HLR decision is not the same document. A Board remand also differs from a final disposition of an appealed issue.
Read the decision and its rights notice carefully. Where a document has multiple issue outcomes or a reconsideration motion is involved, obtain timely help about what is appealable and what date controls rather than assuming every issue follows the same clock.

Use The Current Filing Instructions
The ordinary Notice of Appeal period is 120 days after notice of the final Board decision. The Court, not VA, receives the filing. An intent to file with VA does not replace a Court appeal or extend this period.
Filing methods change. The Court's current instructions distinguish self-represented filing methods from represented case initiation through ACMS beginning October 1, 2026. Use the official instructions linked here for the correct channel, required information, and fee or financial-hardship procedure. This website does not collect the appeal or submit it.
Check Time Computation And Exceptions
Court Rule 26 excludes the triggering day and addresses the last day falling on a weekend, legal holiday, or a day the Court is closed at the Chief Judge's direction. The ordinary calculator includes standard holiday observances but cannot know every exceptional closure or order.
Rule 4 separately addresses timely receipt, certain mailing rules, good cause or excusable neglect in specified circumstances, and equitable tolling. Those provisions are not an automatic extension that everyone can add to the 120-day deadline. Reconsideration and other procedural events require their own review.
Keep Proof And Understand Representation
Retain the Board notice, the Notice of Appeal, delivery confirmation and the Court's docketing information. Check Court admission and representation requirements rather than assuming VA accreditation alone establishes authority to practice before the Court. The Court provides practitioner information and current procedural resources.

Frequently Asked Questions
Can A Court Notice Of Appeal Be Sent To VA Instead?
The Court is a separate filing destination. Follow its current official instructions and preserve proof of filing; sending a document to VA is not the ordinary Court filing procedure.
