Supplemental Claim: A Route For A New Evidentiary Basis

A Supplemental Claim generally asks VA to readjudicate a previously decided issue using new and relevant evidence. New means not previously in the actual record; relevant means tending to prove or disprove a matter at issue. Current VA instructions also allow a review based on a qualifying change in law, such as a newly presumptive condition.

That exception does not make diagnosis, severity or the remaining benefit requirements irrelevant. Identifying evidence VA can help obtain can be part of this route. The ordinary one-year marker concerns continuous pursuit; a Supplemental Claim can generally be filed later with possible effective-date consequences.

Higher-Level Review: Reconsider The Existing Record

An experienced adjudicator who did not participate in the prior decision reviews the record that existed when that decision was issued. New evidence cannot be added through Higher-Level Review. An optional informal conference identifies errors or arguments concerning that existing record; it is not an evidence-submission window.

This route is ordinarily requested within one year of an initial or Supplemental Claim decision. It cannot repeat the same HLR decision or review a Board decision. A found duty-to-assist error can lead to a return for correction rather than an immediate award.

Board Appeal: A Judge And A Selected Docket

A Veterans Law Judge reviews the appealed issues. Direct Review uses the prior decision record; Evidence Submission and Hearing provide defined opportunities to add evidence. Those evidence windows have different starting events, so the word appeal alone does not explain what can be submitted.

An ordinary modernized Board request follows an initial, Supplemental Claim, or HLR decision within one year. Contested claims have separate rules. More than one review route generally cannot proceed simultaneously for the same issue. Compare the actual disputed finding and available record with an accredited representative; a calculator cannot choose the appropriate lane.

Frequently Asked Questions

Is One Review Route Always Best?

No. The evidence record, issue, prior decision type and timing determine which procedures are available. This comparison explains those procedures without choosing a route for an individual claim.
