What Higher-Level Review Can Review

Higher-Level Review reexamines the record as it stood at the prior decision. It does not accept new evidence, even when an informal conference is requested.

Understand The Record Cutoff

The higher-level reviewer considers the evidence in the record when VA issued the decision being reviewed. The purpose is to consider an error or difference of opinion on that existing record. A later medical report does not become part of the HLR record simply because it is relevant.

This boundary separates HLR from a Supplemental Claim and the additional-evidence Board dockets. The right comparison is what the decision had before it, not everything that exists by the time the reviewer looks at the case.

Use The Conference For Its Actual Purpose

An informal conference is optional and gives an opportunity to identify specific errors of fact or law in the prior decision. It is not a sworn evidentiary hearing or a chance to supply facts that were absent from the closed record.

An argument can point to a document already in the record, explain an alleged misapplication of a rule, or clarify which issue is being challenged. Whether a statement is argument or new evidence depends on its content, so an accredited representative can help address that distinction.

A Duty-To-Assist Return Is Not An Award

If the reviewer identifies a pre-decision duty-to-assist error that prevents the maximum benefit from being granted, the issue can return for correction and readjudication. That procedural step does not itself establish service connection, a percentage, or a payment amount.

Development after a return may produce a later decision. Read that subsequent notice rather than treating an earlier status message as a final outcome or using its date for every future deadline.

Check The Available Next Route

HLR is ordinarily requested within one year of an initial or Supplemental Claim decision. A second HLR cannot challenge the same HLR decision, and HLR cannot review a Board decision. After an HLR decision, Supplemental Claim or Board procedures may be available under their own rules. Preserve the letter and confirm the specific issue and filing window.

Frequently Asked Questions

Can New Evidence Be Discussed During The Conference?

An informal conference does not open the evidentiary record. It is for identifying errors and arguments concerning the existing record; new evidence requires an appropriate evidentiary route.
