What Happens If You Miss A VA Review Deadline
A missed VA review window can affect the available review route and effective date. A later Supplemental Claim may still be possible; exceptions need careful review.
Identify Which Clock Has Expired
A decision letter, proposed action, Board decision and intent-to-file confirmation do not share one deadline. Start by identifying the document, the issue, and its date. Ordinary modernized Higher-Level Review and Board requests generally have a one-year window after the underlying agency decision. A Court appeal from a final Board decision ordinarily has 120 days.
An online status update does not replace the dated notice. Keep the actual document and any filing receipt. The deadline calculator illustrates ordinary date math, but it cannot decide disputed receipt, reconsideration, a requested extension, or a Court tolling issue.
A Later Supplemental Claim Is A Different Question
The end of the one-year period does not generally eliminate the Supplemental Claim route. New and relevant evidence is ordinarily needed, while current VA instructions also recognize a qualifying change in law as a basis for review. The question is whether the review can proceed and what effective-date rules govern it, not simply whether a form can be mailed.
Continuous pursuit can preserve a potential earlier effective date when the required review steps are timely. Filing after that chain breaks generally means the new effective date cannot precede receipt of the Supplemental Claim, subject to the applicable exceptions. Approval of the underlying benefit remains a separate question.
Do Not Add An Assumed Grace Period
Weekend, holiday and mailing rules are specific rules with specific conditions. A postmark presumption is not permission to deliberately file late. Similarly, Court provisions addressing good cause or equitable tolling do not turn the ordinary 120-day limit into a longer routine deadline.
If a date has passed, prompt accredited review can separate a later Supplemental Claim, a possible extension or exception, and any remaining route. Preserve the notice, submission confirmation, and records relevant to the timing. This resource does not decide whether an exception applies.

Frequently Asked Questions
Is A Supplemental Claim Barred After One Year?
Generally no. A later Supplemental Claim may remain possible, but the effective-date consequences can be significant and the required basis for review still matters.
