How Supplemental Claim Evidence Rules Work

New and relevant evidence addresses a previously decided issue. A qualifying change in law provides a separate Supplemental Claim basis under current VA instructions.

Read The Missing Finding Before The Evidence Label

New evidence was not previously part of the actual record before the adjudicator. Relevant evidence tends to prove or disprove a matter at issue. A document can be newly created but unrelated to the reason for the prior decision; its date alone does not establish relevance.

Evidence that raises a previously unaddressed theory of entitlement can be relevant. That is different from simply announcing a new theory without evidence. Reading the reasons and favorable findings in the decision helps explain which factual point remains disputed.

Distinguish The Change-In-Law Basis

Current VA instructions permit a Supplemental Claim based on a change in law, including a newly presumptive condition, without requiring new and relevant evidence for that basis. This is a material exception to a blanket statement that every Supplemental Claim must bring a new record.

The remaining claim requirements still matter. VA's instructions discuss medical evidence establishing the condition and its severity. A change in law does not itself establish a particular diagnosis, service fact, or assigned evaluation in every case.

Understand Assistance And The Record

For a substantially complete Supplemental Claim, VA's duty to assist can include gathering identified evidence. The review record includes evidence received before the Supplemental Claim decision notice. This differs from the closed record in Higher-Level Review and from a Board docket's limited additional-evidence windows.

Keep copies and proof of any submission, and use the designated review channel. The claim-status evidence uploader for an initial claim is not a universal submission channel for every review or appeal.

Keep Timing Separate From Evidence Quality

A strong evidentiary basis does not erase an expired continuous-pursuit period. A Supplemental Claim may generally be filed after one year, but the potential effective date can change. Conversely, timely filing does not guarantee that the evidence establishes the benefit sought. Both questions require attention to the actual decision.

Frequently Asked Questions

Does New Mean A Newly Diagnosed Condition?

No. The regulatory definition concerns evidence not previously in the actual record. The evidence still needs to address a matter at issue in the previously decided claim.
